Holiday criminals indicted




Two young Bardstown men who were arrested over the holidays for receiving stolen property and drug possession have been indicted on those charges, and more.

According to a press release from the Bardstown Police Department, an off-duty officer observed the two subjects — identified as Ryan Malinkey, 19, and Justin Rogers, 19, with backpacks in the area of the American Legion Post on West Broadway at around 3:15 a.m. Dec. 23. When the officer confronted the individuals, they fled on foot.
The officer detained one subject, Rogers, who resisted arrest, and the other, Malinkey, continued to flee, according to the release.
Malinkey was located near Brashear Avenue by other officers who had been called to assist. The second subject also resisted arrest, and was transported to Flaget Memorial Hospital to be treated for a facial laceration.
According to the release, both men had items and property reported to have been stolen from vehicles in their possession, and were believed to be under the influence of alcohol.
The two were lodged in the Nelson County Jail. On Jan. 6, 2016, Malinkey and Rogers were indicted for complicity to receiving stolen property, complicity to second-degree fleeing or evading police (on foot), complicity to resisting arrest and complicity to alcohol intoxication.

Rogers was also indicted for third-degree possession of a controlled substance and possession of a prescription not in a proper container.

Malinkey is charged as a first-degree persistent felony offender and Rogers as a second-degree persistent felony offender having previously been convicted of theft by unlawful taking (auto) and receiving stolen property.

Bail was set at $50,000 cash, plus conditions. They are set to be arraigned in court Jan. 21.
