Nelson Circuit Court Indictments: Jan 6, 2016

Note: The indictment of a person by a grand jury or otherwise is an accusation only and that person is presumed innocent until and unless proven guilty.

The following people have been indicted by a Nelson County grand jury. They were set for arraignment in Nelson Circuit Court Jan. 21.

 

• Ryan Malinkey, 19, of Bardstown, complicity to receiving stolen property, complicity to second-degree fleeing or evading police (on foot), complicity to resisting arrest, complicity to alcohol intoxication, first-degree persistent felony offender. On or about Dec. 24, 2015, Malinkey received, retained, or disposed of several items from vehicles located at Mammy’s restaurant, knowingly and wantonly disobeyed a direction to stop, and intentionally prevented or attempted to prevent Chief Rick McCubbin from effecting the arrest of him or another by using threatening physical force or violence and appeared in a public place being manifestly under the influence of alcohol. Malinkey is charged as a first-degree persistent felony offender having previously been convicted of theft by unlawful taking (auto) and receiving stolen property. Bail was set at $50,000 cash, plus conditions.

 

• Thomas L. Jent, 30, of Bardstown, second-degree robbery, first-degree persistent felony offender. On or about March 30, 2015, Jent used physical force upon another while in the course of committing a theft. He is charged as a first-degree persistent felony offender having previously been convicted of first-degree criminal possession of a forged instrument, tampering with physical evidence, complicity to burglary and second-degree assault. Bail was set at $50,000 cash plus conditions.

 

• Justin Tyler Rogers, 19, of Bardstown, complicity to receiving stolen property, complicity to second-degree fleeing or evading police (on foot), complicity to resisting arrest, third-degree possession of a controlled substance, possession of a prescription not in a proper container, complicity to alcohol intoxication, second-degree persistent felony offender. On or about Dec. 24, 2015, Rogers received, retained or disposed of several item from vehicles located at Mammy’s restaurant, knowingly or wantonly disobeyed a direction to stop, intentionally prevented or attempted to prevent Officer Eric Williamson and Officer Derek Sidebottom from effecting the arrest of him or another by using threatening physical force or violence, possessed Xanax pills and appeared in a public place being manifestly under the influence of alcohol. . Rogers is a second-degree persistent felony offender having previously been convicted of complicity to theft by unlawful taking (auto) and receiving stolen property. Bail was set at $50,000 cash, plus conditions.

 

• Maranda Cowles, 26, of Bardstown, complicity to first-degree trafficking in controlled substances, complicity to second-degree trafficking in controlled substances, complicity to first-degree possession of a controlled substance, complicity to possession of drug paraphernalia, complicity to trafficking in marijuana, possession of a prescription not in a proper container. On or about Dec. 23, 2015, Cowles possessed methamphetamine in amount less than two grams with the intent to sell or transfer it, possessed Hydrochloride in an amount less than 20 drug units with the intent to sell or transfer it, possessed heroin, possessed drug paraphernalia, possessed marijuana in an amount less than eight ounces, and possessed a prescription not in its original container. Bail was set at $9,500 cash, plus conditions.

 

• Nicholas J. Gorczyca, 27, homeless, second-degree robbery, first-degree possession of a controlled substance, second-degree disorderly conduct. On or about Sept. 17, 2015, Gorczyca threatened to use physical force upon another while in the course of committing a theft at Kroger, possessed methamphetamine, and engaged in threatening behavior when n public place.  Bail was set at $50,000 cash, plus conditions.

 

• Gerald M. Tucker, 31, of Bardstown, complicity to first-degree trafficking in controlled substances, complicity to second-degree trafficking in controlled substances, complicity to first-degree possession of a controlled substance, complicity to possession of drug paraphernalia, complicity to trafficking in marijuana, complicity to possession of a prescription not in a proper container, first-degree persistent felony offender. On or about Dec. 23, 2015, Tucker possessed methamphetamine in an amount less than two grams with the intent to sell or transfer it, possessed Hydrochloride in an amount less than 20 drug units with the intent to sell or transfer it, possessed heroin, possessed drug paraphernalia, possessed marijuana in an amount less than eight ounces, and possessed a prescription not in its original container. Tucker is a first-degree persistent felony offender having previously been convicted of first-degree wanton endangerment, and complicity to third-degree burglary. Bail was set at $50,000 cash, plus conditions.

 

• Alan F. Metcalfe, 53, of Bardstown, first-degree possession of a controlled substance, possession of drug paraphernalia. On or about Dec. 19, 2015, Metcalfe possessed methamphetamine and drug paraphernalia. Bail was set at $5,000 cash, plus conditions.

 

• Kenneth W. Barnes, 33, of Bardstown, first-degree sexual abuse, fourth-degree assault, five counts third-degree sexual abuse, failure to notify address change to Department of Transportation. On or about Oct. 17, 2015, Barnes engaged in sexual contact with another person by the use of forcible compulsion, grabbed another person, bending her thumb backwards resulting in injury, engaged in sexual contact with another person without their consent, and failed to notify the Department of Transportation of his new address. Bail was set at $50,000 cash, plus conditions. 

 

• Robin G. Tichenor, 40, of Bardstown, first-degree trafficking in controlled substances, first-degree possession of a controlled substance, possession of drug paraphernalia, possession of a controlled substance, possession of marijuana, possession of synthetic drugs, operating a motor vehicle while under the influence of alcohol/drugs, license to be in possession, operating a motor vehicle while license suspended, possession of an open container in a vehicle, failure to illuminate rear license, first-degree persistent felony offender. On or about Nov. 16, 2015, possessed cocaine in an amount less than four grams with intent to sell or transfer it, possessed drug paraphernalia, possessed Buprenorphine, possessed marijuana, possessed synthetic marijuana, operated his vehicle under the influence of alcohol and/or drugs, operated his vehicle while his licenses was suspended, failed to have his license in immediate possession while driving, possessed an open alcoholic beverage in his vehicle, and failed to illuminate his rear license during one-half hour after sunset to one half hour before sunrise. Tichenor is a first-degree persistent felony offender having previously been convicted of trafficking in controlled substances, second-degree robbery, and first-degree wanton endangerment. Bail was set at $9,500 cash, plus conditions.
